The federal trade partnership program has more than 11,400 members and exactly two mentions in the entire Code of Federal Regulations, neither of which establishes it. Congress did not create it; it authorized a program the agency had already been running for five years. Its security criteria are twelve guidance documents. Its benefit sections read shall extend benefits, which may include. Its nineteen arrangements abroad were deliberately drafted to be non-binding, and the agency wrote down why.

The argument

Eleven thousand four hundred partners. Two mentions in the federal code.

Start with the sentence that authorizes it, because the verb is the whole story. The statute says the Secretary is authorized to establish a voluntary government-private sector program. Not shall establish. Not there shall be. Congress wrote that sentence in October 2006 for a program the agency had already been running since November 2001, and the word voluntary is not a commentator's gloss on it but a term inside the operative grant, repeated in the very next section where eligible entities may apply to voluntarily enter into partnerships.1 Then look for the regulations, because a federal program with this many members ought to have some. We searched every title of the Code of Federal Regulations three ways, for the full program name and for both spellings of its abbreviation, and the three searches resolve to two locations in the entire code. One is a vessel manifest provision that requires a carrier to identify which of its importers are members. The other is a privacy appendix listing systems of records exempt from the Privacy Act. Neither establishes the program, sets its eligibility, prescribes its criteria, confers a benefit or governs how a member is removed.2 The criteria themselves are twelve guidance documents, one per member type, dated March 2020, and the congressional audit office records that the 2020 version was the first revision since the original criteria were set in 2001.3 The same section that authorizes the program also instructs that the requirements be reviewed at least once every year, which is a sentence worth setting beside that gap without drawing a conclusion from it.4 And there is a second partnership nested inside the first, which the agency's own federal notice calls an optional component of a voluntary program, open only to importers already certified and in good standing.5

Then read what the partnership actually buys, which is where the language turns. Two sections set out benefits for the two upper tiers and both are built the same way: the agency shall extend benefits to a qualifying participant, which may include a list. The duty attaches to extending something; the content of the something is permissive all the way down, and no item on either list is individually commanded.6 The one number everybody quotes from this statute goes wrong three separate times in a single sentence: the twenty percent is a ceiling and not a promise, it is measured against a high-risk threshold the Secretary sets rather than against the member's own score, and it sits in the entry-tier section whose benefits the statute itself calls limited.7 The three tiers are cleanest understood as a sequence of who does the work - at the first you asserted it, at the second the agency came and verified it, and at the third you exceed a standard whose content the agency writes and revises.8 Benefits can be denied in whole or in part, the procedural protection promised in one sentence is subordinated to national security in the next, and the only mandatory sanction anywhere in the part attaches to knowingly giving false information during validation.9 There is a statutory appeal, it runs to the Secretary rather than to a court, and its two deadlines are the wrong way round: ninety days to contest losing a benefit, thirty days to contest being expelled.10

Abroad, the partnership becomes nineteen arrangements with foreign customs administrations, signed between 2007 and 2025.11 They are not treaties, and the agency has published both the fact and the reason: it enters into arrangements to show the documents are non-binding, which allows it to maintain its law enforcement discretion.12 One of the nineteen was signed by two organizations that are neither government, a detail the agency records in a one-sentence footnote.13 And recognition does less than the market believes - it is based on security, does not address compliance, and exempts no partner from any other requirement.14 Which leaves the counting, and the counting is the part that should make a buyer sit up. The agency's own program page says more than 11,400 certified partners moving over 52 percent of import value by value, and a federal notice three weeks earlier describes roughly 70 percent of that membership as small businesses.15 Go looking for a harder number and you find three live figures from three agency documents dated thirteen years apart, one of which is not a membership count at all.16 An audit published in January 2026 found approximately 2,200 security incidents involving 480 participants across five fiscal years and made six recommendations.17 We did not divide those two numbers, and we did not read the agency's own impact report, because it is a 3.72 megabyte file our retrieval could not open - which is on card 18, in print, along with everything else we could not read.18 Last, the thing this market most wants the partnership to mean and which it does not: against a forced labor detention it buys queue position, custody of the goods while you argue, and an early warning given to the best of the program's ability. The prohibiting statute mentions no partnership program and creates no exception for one.19 Fourteen further claims this page refused to make are published together, so they can be checked against every card above.20

Recognition is about
security. It is not about
compliance, and it excuses
you from nothing.

The most expensive misunderstanding in this part of the market is that recognition abroad does something about customs compliance, or lifts a requirement somewhere. The agency has written the opposite in plain words, and the words are short enough to print whole.

LIMIT 1 OF 3, WHAT IT DOES NOT TOUCHRecognition does not exempt any partner, whether domestic or foreign, from complying with other CBP mandated requirements and cargo enforcement strategies. Advance filing obligations continue to apply.NO EXEMPTION
LIMIT 2 OF 3, THE SUBJECT MATTERThe arrangements are based on security. The agency states they do not address customs compliance issues. A member whose compliance record is the problem has not solved it by being recognized.SECURITY ONLY
LIMIT 3 OF 3, A BENEFIT THAT IS NOT IN THEMBusiness resumption priority, which the program envisions for its members, is not a factor that is included in any MRA. It is a program benefit and not a recognized one.NOT INCLUDED
WHAT RECOGNITION ACTUALLY IS, STATED POSITIVELYA foreign customs administration agrees to treat the other's validated members as lower risk within its own targeting. That is a real and valuable thing, and it is a narrower thing than the market's shorthand for it. The accurate sentence is that recognition can change how a foreign administration scores you. It does not change what either administration requires of you.

Two figures the agency published itself, from two documents a year apart, describe the membership from opposite directions. One counts the members and the share of import value they move. The other says what kind of company most of them are. Together they describe a constituency almost nobody pictures correctly.

In January 2026 the congressional audit office published a report on how the program is managed. We read the report's public summary page directly. Two figures on it are worth printing exactly, and the number of recommendations is worth printing beside them.

WHAT A SECURITY INCIDENT IS NOTIt is not a finding of wrongdoing by the member, and the report does not present it as one. A participant can report an incident precisely because the program asks it to. Treating the count as a scorecard of member conduct would be a misreading.NOT A SCORECARD
AND THE ARITHMETIC THIS PAGE REFUSESFour hundred eighty against eleven thousand four hundred is a tempting percentage. 01The program's 2025 impact report, a 3.72 MB document dated July 28, 2026 and linked from the agency's own program page. Automated retrieval returned a refusal. If a breakdown of members by business type exists anywhere, it most likely exists here. Nothing on this page comes from it, and card 15's statement that the program page prints no breakdown is scoped to that page.

03The full text of the audit report discussed on card 17. We read its public summary page and took only what that page states. Two phrases quoted elsewhere on this site, conditionally entitled on card 06 and not legally required to do so on card 09, are attributed to a secondary description of that report rather than to the report itself, and both cards say so.
04The text of any signed mutual recognition arrangement. The agency does not appear to publish the instruments. Card 12 is therefore worded as what the agency says about them, not as what they say about themselves.
05Two agency publications on forced labor requirements, a frequently-asked-questions document dated November 18, 2025 and a bulletin dated July 2026. Card 19 is written without them, and says so.

This is where the market most wants the partnership to mean something it does not mean. The benefits here are genuine and dated, and they are procedural. The legal test a member faces is the same test everyone else faces, and the governing statute contains nothing about any partnership program.

BENEFIT ONE, NOVEMBER 14, 2022Front-of-the-line admissibility review. A member with a detained shipment can have its package prioritized, on asserting active membership and requesting it.QUEUE
BENEFIT TWO, NOVEMBER 14, 2022A redelivery benefit. The member may hold the affected shipment intact at its own facility rather than returning it, pending a determination or a required inspection.CUSTODY
BENEFIT THREE, MARCH 5, 2023Preliminary notification of a possible hold, detention, exclusion or seizure, given to the best of the program's ability. Expanded on May 30, 2023 to cover all forced labor enforcement actions.WARNING
AND HERE IS WHAT NONE OF THEM DOESThe prohibiting statute carries the US Code heading Convict-made goods; importation prohibited, and provides that goods made wholly or in part by convict, forced or indentured labor under penal sanctions shall not be entitled to entry. It contains no reference to any partnership program and no exception based on one. The 2021 Act creates a rebuttable presumption and does not mention the program anywhere. The interagency strategy that Act required does not mention it either. A member and a non-member meet the same presumption and the same clear-and-convincing standard. One of them hears about it sooner and keeps the pallets in its own warehouse while it argues.
THESE BENEFITS BELONG TO THE SECOND PROGRAM DESCRIBED ON CARD 05, NOT TO THE SECURITY PROGRAM, SO A CERTIFIED FOREIGN MANUFACTURER OR HIGHWAY CARRIER CANNOT REACH THEM. 01That any agency failed a legal duty, is out of compliance, or administers the program badly. Card 04 sets a statutory sentence beside an audit finding and deliberately stops there.
02That the statute disclaims a private right of action, or that it creates one. We searched the public law for rule-of-construction and savings language and found none touching this program. Both the positive and the negative claim would be unsourced.
03That members receive a twenty percent reduction in their risk score. Card 07 is the three separate ways that sentence goes wrong.
04That membership reduces duties or tariffs. No statutory or published benefit touches a rate of duty. Every one of them is about examination, targeting, processing, queueing or information.
05That membership is a safe harbor against a forced labor detention. Card 19 is what the three real benefits are and what the statute actually says.
06That the mutual recognition instruments are treaties, agreements or binding. Card 12 is the agency explaining why they are arrangements.
07That there are nineteen countries. One entry is not a country and one was signed by neither government. Cards 11 and 13.
08Any count of members by business type, or by tier. We found none published on the program page, we could not open the impact reports, and we will not multiply a percentage from one source by a total from another to invent one.
09The figure around ten thousand nine hundred, widely attributed to a live agency page. We went to the page and could not see it. Card 16.
10Any percentage of members involved in security incidents. Card 17 is why the two figures cannot be divided.
11Any current funding figure for the program. The authorizations in the statute ended with fiscal year 2010 for the program and fiscal year 2012 for personnel and were never renewed in the Code, so any number there would be stale by more than a decade.
12That there is no appeal from a suspension, or that you have ninety days to bring one. There is an appeal and the window is thirty days. Card 10.
13That a list of suspended or expelled participants exists. The statute permits the agency to publish one. We looked and did not find one, which is not the same as establishing that none exists.
